Judicial Power and Influence on Population Health

L. O. Gostin

Summary: Since its founding, the Supreme Court has played a major role in defining public health powers and individual health-related rights. The recent shift towards a conservative supermajority has resulted in a Court willing to overturn long-held precedent and dismantle public health policies based on ideology. This poses a threat to public health issues such as infectious disease control, reproductive rights, LGBTQ+ rights, firearm safety, immigration, and climate change. Congress has the power to curb the Court's extreme actions without compromising its non-political nature by taking steps such as limiting nationwide injunctions and altering the appointment and term limits of federal judges and Supreme Court Justices.

The Global Health Architecture: Governance and International Institutions to Advance Population Health Worldwide

Lawrence O. Gostin, Eric A. Friedman, Alexandra Finch

Summary: Global health institutions and instruments need to be reformed to incorporate principles of good health governance, such as the right to health, equity, inclusive participation, transparency, accountability, and global solidarity. New legal instruments, like International Health Regulations amendments and the pandemic treaty, should be based on these principles. Equity should be integrated into all aspects of health threats, and low- and middle-income countries should be empowered to produce their own medical resources through regional mRNA vaccine manufacturing hubs.

Summary: The World Health Organisation (WHO) was established in 1948 to ensure the highest standard of health globally. However, it currently faces challenges to its authority due to the ongoing COVID-19 pandemic. Reforms in financing, governance, norms, human rights, and equity are necessary for the future of WHO and global health governance.
