Revise the Uniform Determination of Death Act to Align the Law With Practice Through Neurorespiratory Criteria

Adam Omelianchuk, James Bernat, Art Caplan, David Greer, Christos Lazaridis, Ariane Lewis, Thaddeus Pope, Lainie Friedman Ross, David Magnus

Summary: The Uniform Determination of Death Act (UDDA) has been a model statute for 40 years, but there is a growing recognition that it needs to be updated, especially in terms of aligning the legal criteria for determining death with the medical standards. This article argues for revising the UDDA to specify neurorespiratory criteria, which include permanent loss of consciousness, ability to breathe spontaneously, and brainstem reflexes, as the criteria for determining death.

Neurologic Diseases and Medical Aid in Dying: Aid-in-Dying Laws Create an Underclass of Patients Based on Disability

Lonny Shavelson, Thaddeus M. Pope, Margaret Pabst Battin, Alicia Ouellette, Benzi Kluger

Summary: In the United States, terminally ill patients have the right to end their lives using prescribed medications, but patients with neuromuscular disabilities are excluded if they cannot self-administer the medications. This exclusion contradicts disability rights laws and may result in unequal access to medical care for these patients compared to those with other terminal illnesses.

Consent for determination of death by neurologic criteria in Canada: an analysis of legal and ethical authorities, and consensus-based working group recommendations

Thaddeus M. Pope, Jennifer A. Chandler, Michael Hartwick

Summary: This article discusses whether physicians should obtain consent from patients or surrogate decision-makers to determine death by neurologic criteria. Current legal and ethical authorities suggest that consent is not required, and professional guidelines and court decisions support this view. However, physicians should still inform families of their intent and offer accommodations when possible. The article is part of a collaborative project in Canada and does not provide specific legal advice.
